ข้อกำหนดการใช้งานTerms of Service

โปรดอ่านข้อกำหนดการใช้งานฉบับนี้ (“ข้อกำหนด”) โดยละเอียดก่อนใช้งานแอปพลิเคชัน PugEV การกดยอมรับหรือการใช้งานแอปถือว่าคุณตกลงผูกพันตามข้อกำหนดนี้ หากคุณไม่ยอมรับ กรุณาอย่าใช้งานแอป

1. ผู้ให้บริการ

แอปพลิเคชัน PugEV (“แอป”, “บริการ”) พัฒนาและดำเนินการโดยนักพัฒนาอิสระ (“เรา”) ติดต่อได้ที่อีเมล [email protected]

2. บริการของเราคืออะไร

PugEV เป็นแอปสำหรับค้นหาสถานีชาร์จรถยนต์ไฟฟ้าในประเทศไทย โดยรวบรวมข้อมูลสถานี ตำแหน่ง หัวชาร์จ และสถานะการใช้งานจากผู้ให้บริการสถานีชาร์จภายนอก (“ผู้ให้บริการสถานี”) มาแสดงในที่เดียว พร้อมฟีเจอร์ค้นหา นำทาง บันทึกทริป และรีวิวสถานี

สิ่งที่ PugEV ไม่ได้ทำ — โปรดเข้าใจก่อนใช้งาน:

  • เราไม่ได้เป็นเจ้าของหรือดำเนินการสถานีชาร์จใด ๆ
  • เราไม่มีระบบจองสถานีหรือหัวชาร์จ และไม่สามารถรับประกันว่าหัวชาร์จจะว่างเมื่อคุณไปถึง
  • เราไม่รับชำระเงินค่าชาร์จหรือค่าบริการใด ๆ — การชาร์จ การจอง และการชำระเงินทั้งหมดเกิดขึ้นในแอปหรือระบบของผู้ให้บริการสถานีแต่ละราย ซึ่งอยู่ภายใต้ข้อกำหนดของผู้ให้บริการรายนั้น

3. คุณสมบัติของผู้ใช้

  • คุณต้องมีอายุ 13 ปีขึ้นไป จึงจะใช้งานแอปได้
  • หากคุณยังไม่บรรลุนิติภาวะตามกฎหมาย การใช้งานแอปควรได้รับความยินยอมจากผู้ปกครองหรือผู้แทนโดยชอบธรรม

4. บัญชีผู้ใช้

  • แอปเปิดให้เข้าสู่ระบบผ่านบัญชี Google, LINE หรือ Apple การใช้บริการเข้าสู่ระบบเหล่านี้อยู่ภายใต้ข้อกำหนดของผู้ให้บริการแต่ละราย
  • คุณมีหน้าที่รักษาความปลอดภัยของบัญชีที่ใช้เข้าสู่ระบบ และรับผิดชอบต่อกิจกรรมที่เกิดขึ้นผ่านบัญชีของคุณ
  • คุณสามารถลบบัญชีได้ด้วยตนเองในแอป ที่หน้าตั้งค่าบัญชี การลบบัญชีจะลบข้อมูลส่วนบุคคลของคุณตามที่ระบุในนโยบายความเป็นส่วนตัว

5. ความถูกต้องของข้อมูล

ข้อมูลสถานี ราคา จำนวนหัวชาร์จ และสถานะการใช้งาน (“ข้อมูลสถานี”) มาจากระบบของผู้ให้บริการสถานีภายนอก เราแสดงข้อมูลตามที่ได้รับมาอย่างสุดความสามารถ แต่:

  • ข้อมูลสถานีอาจไม่ถูกต้อง ไม่ครบถ้วน หรือล่าช้าจากสถานะจริง ณ ขณะนั้น
  • เวลาเดินทางโดยประมาณเป็นการคำนวณ ไม่ได้คิดรวมสภาพจราจรจริง
  • โปรดตรวจสอบกับผู้ให้บริการสถานีอีกครั้งก่อนตัดสินใจเดินทางไกลโดยอาศัยข้อมูลในแอปเพียงอย่างเดียว

6. การนำทางและความปลอดภัย

  • ฟีเจอร์นำทางมีไว้เพื่อช่วยอำนวยความสะดวกเท่านั้น ไม่ใช่สิ่งทดแทนวิจารณญาณของผู้ขับขี่
  • ห้ามใช้งานแอปขณะขับขี่ โปรดตั้งค่าเส้นทางก่อนออกเดินทาง และปฏิบัติตามกฎจราจร ป้าย และสภาพถนนจริงเสมอ ซึ่งมีความสำคัญเหนือกว่าคำแนะนำใด ๆ จากแอป

7. เนื้อหาที่ผู้ใช้สร้าง (รีวิว รูปภาพ และอื่น ๆ)

เมื่อคุณโพสต์รีวิว ให้คะแนน หรืออัปโหลดรูปภาพในแอป (“เนื้อหาของผู้ใช้”):

  • คุณยังคงเป็นเจ้าของเนื้อหาของคุณ แต่คุณอนุญาตให้เราใช้ แสดง ทำซ้ำ และเผยแพร่เนื้อหานั้นภายในบริการของ PugEV โดยไม่มีค่าตอบแทน เพื่อให้บริการทำงานได้ (เช่น แสดงรีวิวของคุณให้ผู้ใช้รายอื่นเห็น)
  • คุณรับรองว่าเนื้อหาที่โพสต์เป็นของคุณหรือคุณมีสิทธิ์โพสต์ และเป็นไปตามความจริงจากประสบการณ์การใช้งานจริง
  • ห้ามโพสต์เนื้อหาที่ผิดกฎหมาย หมิ่นประมาท คุกคาม ลามกอนาจาร ละเมิดสิทธิ์ผู้อื่น เป็นสแปม โฆษณา หรือข้อมูลเท็จโดยเจตนา
  • เราขอสงวนสิทธิ์ในการลบหรือซ่อนเนื้อหาที่ฝ่าฝืนข้อกำหนดนี้ โดยไม่จำเป็นต้องแจ้งล่วงหน้า

8. ข้อห้ามในการใช้งาน

คุณตกลงว่าจะไม่:

  • ใช้แอปเพื่อวัตถุประสงค์ที่ผิดกฎหมาย
  • ดึงข้อมูล (scrape) เข้าถึง API ของเราโดยไม่ได้รับอนุญาต หรือใช้งานระบบอัตโนมัติเพื่อเก็บข้อมูลจากบริการ
  • แทรกแซง ทำลาย หรือสร้างภาระเกินสมควรต่อระบบของเรา
  • ทำวิศวกรรมย้อนกลับ ดัดแปลง หรือหลบเลี่ยงมาตรการความปลอดภัยของแอป
  • ปลอมแปลงตัวตน หรือใช้บัญชีของผู้อื่นโดยไม่ได้รับอนุญาต

การฝ่าฝืนอาจส่งผลให้เราระงับหรือยกเลิกบัญชีของคุณ

9. บริการและลิงก์ของบุคคลภายนอก

แอปมีลิงก์และปุ่มส่งต่อไปยังแอปหรือหน้าดาวน์โหลดของผู้ให้บริการสถานี รวมถึงใช้บริการแผนที่ ข้อมูลสถานที่ และการเข้าสู่ระบบจากบุคคลภายนอก บริการเหล่านั้นอยู่นอกเหนือการควบคุมของเรา และอยู่ภายใต้ข้อกำหนดและนโยบายของผู้ให้บริการแต่ละราย เราไม่รับผิดชอบต่อเนื้อหา บริการ หรือความเสียหายที่เกิดจากบริการของบุคคลภายนอก

10. ทรัพย์สินทางปัญญา

  • แอป โลโก้ การออกแบบ และซอฟต์แวร์ของ PugEV เป็นทรัพย์สินของเรา ห้ามคัดลอก ดัดแปลง หรือนำไปใช้ในเชิงพาณิชย์โดยไม่ได้รับอนุญาต
  • ชื่อ เครื่องหมายการค้า และข้อมูลของผู้ให้บริการสถานีเป็นทรัพย์สินของเจ้าของแต่ละราย การแสดงข้อมูลในแอปไม่ได้หมายความว่าผู้ให้บริการรายนั้นรับรองหรือเกี่ยวข้องกับ PugEV

11. ข้อมูลส่วนบุคคล

การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของคุณเป็นไปตามนโยบายความเป็นส่วนตัวซึ่งเป็นเอกสารแยกต่างหาก คุณสามารถจัดการความยินยอมแต่ละรายการ (เช่น การเข้าถึงตำแหน่ง การเก็บข้อมูลการใช้งาน) ได้ตลอดเวลาในหน้าตั้งค่าของแอป ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA)

12. การให้บริการ “ตามสภาพ”

บริการนี้ให้บริการโดยไม่คิดค่าใช้จ่ายและตามสภาพที่เป็นอยู่ (as is) เราไม่รับประกันว่าบริการจะปราศจากข้อผิดพลาด ต่อเนื่อง หรือพร้อมใช้งานตลอดเวลา เราอาจปรับปรุง เปลี่ยนแปลง ระงับ หรือยุติบริการทั้งหมดหรือบางส่วนได้ทุกเมื่อ

13. ข้อจำกัดความรับผิด

ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายพิเศษ หรือความเสียหายต่อเนื่องใด ๆ ที่เกิดจากการใช้หรือไม่สามารถใช้บริการ รวมถึงแต่ไม่จำกัดเพียง: ความเสียหายจากข้อมูลสถานีที่ไม่ถูกต้อง หัวชาร์จไม่ว่างหรือใช้งานไม่ได้ แบตเตอรี่หมดระหว่างทาง เส้นทางหรือเวลาเดินทางที่คลาดเคลื่อน หรือการกระทำของผู้ให้บริการสถานี

ทั้งนี้ ข้อกำหนดนี้ไม่ตัดสิทธิ์ที่คุณพึงมีตามกฎหมายคุ้มครองผู้บริโภคที่ไม่อาจสละได้

14. การระงับและยกเลิกบัญชี

เราอาจระงับหรือยกเลิกบัญชีของคุณหากพบการฝ่าฝืนข้อกำหนดนี้ การใช้งานที่เป็นอันตรายต่อระบบหรือผู้ใช้รายอื่น หรือตามที่กฎหมายกำหนด คุณสามารถยุติการใช้งานได้ทุกเมื่อโดยการลบบัญชีในแอป

15. การเปลี่ยนแปลงข้อกำหนด

เราอาจแก้ไขข้อกำหนดนี้เป็นครั้งคราว เมื่อมีการเปลี่ยนแปลงที่มีนัยสำคัญ แอปจะแสดงข้อกำหนดฉบับใหม่ให้คุณอ่านและยอมรับก่อนใช้งานต่อ เวอร์ชันและวันที่มีผลบังคับใช้ระบุไว้ที่ด้านบนของเอกสารนี้

16. กฎหมายที่ใช้บังคับ

ข้อกำหนดนี้อยู่ภายใต้บังคับและตีความตามกฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทใด ๆ ให้อยู่ในเขตอำนาจของศาลไทย

Please read these Terms of Service (the “Terms”) carefully before using the PugEV application. By accepting them, or by using the app, you agree to be bound by these Terms. If you do not accept them, please do not use the app.

1. Who provides the service

The PugEV application (the “app”, the “service”) is developed and operated by an independent developer (“we”, “us”). You can reach us at [email protected].

2. What our service is

PugEV is an app for finding electric-vehicle charging stations in Thailand. It gathers station data, locations, connectors and availability status from external charging network operators (“station operators”) and shows it in one place, with search, navigation, saved trips and station reviews.

What PugEV does not do — please understand this before using it:

  • We do not own or operate any charging station.
  • We have no reservation system for stations or connectors, and we cannot guarantee a connector will be free when you arrive.
  • We do not take payment for charging or any service — charging, booking and payment all happen in each station operator’s own app or system, under that operator’s terms.

3. Who may use the app

  • You must be 13 years or older to use the app.
  • If you are below the legal age of majority, your use of the app should have the consent of a parent or legal guardian.

4. Accounts

  • The app allows sign-in with a Google, LINE or Apple account. Use of those sign-in services is governed by each provider’s own terms.
  • You are responsible for keeping your sign-in account secure, and for activity that takes place through your account.
  • You can delete your account yourself in the app, under account settings. Deleting your account deletes your personal data as described in the Privacy Policy.

5. Accuracy of information

Station data, prices, connector counts and availability status (“station data”) come from external station operators’ systems. We display what we receive to the best of our ability, but:

  • Station data may be inaccurate, incomplete, or behind the real state at that moment.
  • Estimated travel times are calculated and do not account for actual traffic conditions.
  • Please check with the station operator again before committing to a long drive on the basis of the app’s data alone.

6. Navigation and safety

  • Navigation is a convenience feature only. It is not a substitute for the driver’s own judgement.
  • Do not operate the app while driving. Set your route before you set off, and always follow traffic law, signage and actual road conditions, which take precedence over any guidance from the app.

7. User-generated content (reviews, photos and so on)

When you post a review, give a rating, or upload a photo in the app (“your content”):

  • You keep ownership of your content, but you grant us permission to use, display, reproduce and distribute it within the PugEV service, without payment, so the service can function (for example, showing your review to other users).
  • You confirm that the content is yours or that you have the right to post it, and that it reflects your genuine experience.
  • Do not post content that is unlawful, defamatory, harassing, obscene, infringing on others’ rights, spam, advertising, or knowingly false.
  • We reserve the right to remove or hide content that breaches these Terms, without prior notice.

8. Prohibited use

You agree not to:

  • Use the app for any unlawful purpose.
  • Scrape data, access our API without permission, or use automated systems to collect data from the service.
  • Interfere with, damage, or place an unreasonable load on our systems.
  • Reverse-engineer, modify, or circumvent the app’s security measures.
  • Impersonate anyone, or use another person’s account without permission.

A breach may result in us suspending or terminating your account.

9. Third-party services and links

The app contains links and buttons that hand off to station operators’ apps or download pages, and it uses third-party mapping, place data and sign-in services. Those services are outside our control and are governed by each provider’s own terms and policies. We are not responsible for third-party content, services, or any damage arising from them.

10. Intellectual property

  • The PugEV app, logo, design and software are our property. Do not copy, modify or use them commercially without permission.
  • Station operators’ names, trade marks and data belong to their respective owners. Showing their information in the app does not mean that operator endorses or is affiliated with PugEV.

11. Personal data

Collection, use and disclosure of your personal data is governed by the Privacy Policy, which is a separate document. You can manage each consent individually (for example location access, or usage analytics) at any time in the app’s settings, in line with Thailand’s Personal Data Protection Act B.E. 2562 (PDPA).

12. Service provided “as is”

This service is provided free of charge and as is. We do not warrant that it will be error-free, uninterrupted, or available at all times. We may improve, change, suspend or discontinue all or part of the service at any time.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, special or consequential damages arising from the use of, or inability to use, the service — including but not limited to: damage from inaccurate station data, a connector being occupied or out of order, running out of battery en route, inaccurate routes or travel times, or the acts of a station operator.

Nothing in these Terms removes rights you have under consumer protection law that cannot be waived.

14. Suspension and termination

We may suspend or terminate your account if we find a breach of these Terms, use that is harmful to our systems or to other users, or where the law requires it. You may stop using the service at any time by deleting your account in the app.

15. Changes to these Terms

We may revise these Terms from time to time. When a change is significant, the app will show you the new version to read and accept before you continue. The version and effective date are stated at the top of this document.

16. Governing law

These Terms are governed by and construed under the laws of the Kingdom of Thailand. Any dispute falls under the jurisdiction of the Thai courts.
